Has Canada violated our rights under the International Covenant on Civil and Political Rights?
We claim that Canada has severely violated our rights under the International Covenant on Civil and Political Rights:
1. Article 1 paragraph (a) the right of self-determination. We had been denied the right to freely determine and pursue our economic, social and cultural development after Canada had recruited us for the very same professional skills, education and experience. But we also belong to a large group of similar people in similar circumstances who are rapidly becoming Canada’s next underclass. A group who is not in control of its own destiny.
2. Article 1 paragraph (b) the right to freely dispose of their natural wealth and resources. As a requirement by immigration, we had sold all our material effects including our house we lived in United Kingdom settled any outstanding debts and brought the required funds and more to Canada. We came with good credit records, no debts, and our intention was to use the money from the sale of our home in England as a down payment towards a house in Canada. Due to the fact that we were immediately denied work we had to use these funds to survive further, to re-train, to re-educate, job-hunt and in the process faced various forms of exploitation by colleges, agencies etc. It seems everyone wants to make money out of newcomers in this country. In the end we used these monies to contribute to the Canadian economy but we did not benefit in return through the very same economy. Pain, suffering and financial loss are the old and new hallmarks of Canada’s mass immigration policy. Canada deprives us of our means of rightful subsistence to this very day.
3. According to Article 2 Canada must respect and ensure the rights of the Covenant to all persons within its jurisdiction. If necessary, legislation should be enacted to properly guarantee these rights. Crucially, it states that signatories are required to provide remedies to persons whose rights under the Covenant are breached. What remedy has Canada provided us?
When we brought our problem before the government, the tribunals and the court system, our problem was ignored and the courts punished us for bringing the matter forward. Further we were forced into bankruptcy and kept in bankruptcy so that we will not be able to proceed legally and open a can of worms that can lead to the opening of a floodgate. The combined forces of discrimination, hidden institutionalized bias and prejudice from employers, job agencies, job training centres, professional bodies, government bodies and the courts have made us second tier citizens of this country and deprived us from working within our fields for over 8 years and sadly the Canadian government then and now has supported this by turning a blind eye to our plight for our rights ignoring its own pledge to the International Covenant on Civil and Political Rights Article 1(c) and 2.
